When more than one classification applies to operations that are closely related, it is important to understand the boundaries of each classification. For example, the WCIRB has fielded questions regarding Classification 0042, Landscape Gardening, and 0106, Tree Pruning, Repairing or Trimming, such as:
Classification 0106 appears in the California Workers' Compensation Uniform Statistical Reporting Plan–1995 (USRP) as follows:
TREE PRUNING, REPAIRING OR TRIMMING – N.O.C. – hand or mechanical power – including yard employees
This classification includes spraying or fumigating in connection with tree pruning, repairing or trimming.
Classification 0106 includes "N.O.C.", which is an abbreviation for not otherwise classified. This indicates that some specific type of tree pruning, repairing or trimming work may qualify for a classification other than 0106. In this case, that other classification is 0042.
Classification 0042 was amended effective January 1, 2014. The amendments were not intended to change the way Classification 0042 has been administered, but instead clarify and update the classification information. Classification 0042 is shown below:
LANDSCAPE GARDENING – all operations – including maintenance of gardens
This classification includes the construction, maintenance, repair, and installation of landscape systems and facilities for public and private gardens and other areas which are designed to aesthetically, architecturally, horticulturally, or functionally improve the grounds within or surrounding a structure or a tract or plot of land. Such operations include the preparation and grading of plots and areas of land for the installation of any architectural, horticultural and decorative treatment or arrangement. It also includes trimming or pruning trees when performed exclusively at ground level.
When performed by the same employer that is primarily engaged in landscape work at a particular job or location, this classification shall include the construction or installation of hardscape features including, but not limited to, decorative pools, fountains, drainage and sprinkler systems, garden furniture, statuary and monuments.
This classification shall not include the pruning, repairing or trimming of large, mature trees when any portion of the operations requires elevation using ladders, lifts or by climbing. Such operations, including ground crews, shall be classified as 0106, Tree Pruning, Repairing or Trimming.
The excavating, transporting and transplanting of mature trees shall be separately classified as 7219(1), Trucking Firms.
Classification 0042 specifies that it applies to the construction, maintenance, repair, and installation of landscape systems and includes trimming or pruning trees when performed exclusively at ground level. Accordingly, the trimming of small landscape trees is within the scope of Classification 0042 provided all work is conducted at ground level.
The classification also specifies that it shall not include the pruning, repairing or trimming of large, mature trees when any portion of the operations requires elevation using ladders, lifts or by climbing. In such cases, all operations, including ground crews, shall be classified as 0106, Tree Pruning, Repairing or Trimming.
